1. Acceptance of Terms

By accessing or using Reaipela Cleaners Marketplace (“the Platform”), including booking cleaning or gardening services or registering as a service provider, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use this Platform.

These Terms constitute a legally binding agreement between you (“User,” “Customer,” or “Provider” as applicable) and Reaipela Cleaners Marketplace.

2. Description of Service

Reaipela Cleaners Marketplace operates an online marketplace platform that:

  • Connects customers with independent cleaning and gardening service providers

  • Facilitates booking and payment management via reaipelacleaners.co.za

  • Dispatches job requests to 3–5 providers in the customer’s area

  • Manages reviews, ratings, and weekly payouts to providers

  • Charges a 15% commission on all completed jobs

Important: Reaipela Cleaners Marketplace is not an employer of service providers. Providers are independent contractors responsible for their own work, taxes, and insurance.

3. Eligibility

3.1 Customers

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our booking services.

3.2 Service Providers

To register as a service provider, you must:

  • Be at least 18 years old

  • Have a registered business with valid documentation

  • Provide proof of BEECA affiliation (preferred)

  • Maintain a positive online reputation

  • Pass our vetting process managed via motelo.co.za

  • Have the capacity to complete cleaning or gardening jobs professionally

4. Customer Terms

4.1 Booking Process

  1. Online Booking: Customer selects cleaning or gardening service via reaipelacleaners.co.za

  2. Payment: Payment is processed instantly upon booking confirmation

  3. Dispatch: Job is sent to 3–5 providers in your area

  4. Acceptance: Provider accepts via their portal and completes the job

  5. Review: Customer rates and reviews the service after completion

4.2 Payment and Pricing

  • All prices displayed are in South African Rand (ZAR)

  • Payment is required upfront to confirm booking

  • Payments are processed securely through our payment gateway

  • Commission: 15% is deducted from provider’s earnings (not added to customer price)

  • Prices are subject to change based on service scope, location, and frequency

4.3 Cancellations and Refunds

  • Customer cancellation: Contact us at least 24 hours before scheduled service for full refund

  • Cancellations within 24 hours may incur a 50% cancellation fee

  • No-shows by providers result in full refund and rebooking priority

  • Refunds are processed within 5–7 business days

4.4 Service Expectations

  • We dispatch multiple providers but do not guarantee which provider will accept your job

  • Service quality depends on the individual provider you are matched with

  • We facilitate resolution of disputes but do not guarantee specific outcomes

  • Customers must provide safe, accessible work environments for providers

5. Service Provider Terms

5.1 Registration and Vetting

  • All providers must complete our vetting process managed by Mziyanda via motelo.co.za

  • You must provide accurate business registration, contact, and banking information

  • We reserve the right to reject or terminate any provider at our discretion

  • Providers must maintain accurate portal profiles and availability status

5.2 Commission and Payouts

  • Commission Rate: 15% of all completed job values

  • Payout ScheduleWeekly payouts released after customer review and confirmation

  • Payout Workflow: Tested and operational at launch (June 8, 2026)

  • Deductions: Commission is deducted before payout to provider

  • Banking Details: Provider must maintain accurate, verified banking information

  • Invoicing: Monthly invoices provided for all completed jobs (R20K+ monthly revenue tracked)

5.3 Job Acceptance and Performance

  • Providers receive job notifications for 3–5 providers per job in their area

  • Providers must accept or decline jobs promptly via the portal

  • Acceptance Rate: Providers must maintain minimum 70% acceptance rate to remain active

  • Completion: Once accepted, providers must complete the job professionally

  • Documentation: Providers must upload before/after forms for all completed jobs

  • Quality Standards: Work must meet industry standards and customer expectations

5.4 Provider Responsibilities

As an independent contractor, you agree to:

  • Perform all services professionally, safely, and in compliance with applicable laws

  • Maintain your own tools, equipment, and transportation

  • Obtain appropriate insurance coverage for your work

  • Pay your own taxes, VAT, and statutory contributions

  • Respect customer property and maintain confidentiality

  • Address customer concerns professionally and promptly

  • Maintain BEECA affiliation and business registration validity

5.5 Termination of Provider Account

We may suspend or terminate your provider account if you:

  • Fail to meet quality standards or performance metrics

  • Receive multiple negative reviews or complaints

  • Provide false or misleading information during vetting

  • Violate these Terms or customer property

  • Engage in fraudulent or illegal activities

  • Fail to maintain required business documentation

6. Intellectual Property

6.1 Platform Ownership

  • All content on reaipelacleaners.co.za (logos, text, graphics, software, design) is owned by Reaipela Cleaners Marketplace

  • Protected by South African and international copyright laws

  • You may not reproduce, distribute, or modify content without written permission

6.2 User Content

  • Customers and providers retain ownership of content they submit (reviews, photos, before/after forms)

  • By submitting content, you grant us a non-exclusive, worldwide license to use, display, and promote it

  • You warrant that content you submit does not infringe third-party rights

7. Privacy and Data Protection

Your use of this Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in the Privacy Policy, in compliance with POPIA.

8. Disclaimers and Limitations of Liability

8.1 “As Is” Service

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to:

  • Uninterrupted or error-free operation

  • Suitability for specific purposes

  • Accuracy of provider information or availability

8.2 Limitation of Liability

To the maximum extent permitted by law, Reaipela Cleaners Marketplace:

  • Is not liable for damages arising from service provider performance, non-performance, or negligence

  • Is not responsible for injuries, property damage, or losses occurring during service delivery

  • Maximum liability is limited to the amount you paid for the specific booking

  • Is not liable for indirect, incidental, or consequential damages

8.3 Provider Conduct

  • We facilitate connections but do not endorse individual providers

  • Provider actions, omissions, and conduct are solely their responsibility

  • We reserve the right to remove providers but assume no liability for provider actions

9. Indemnification

You agree to indemnify and hold harmless Reaipela Cleaners Marketplace, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform

  • Your breach of these Terms

  • Your services (for providers) or conduct (for customers)

  • Your infringement of third-party rights

10. Dispute Resolution

10.1 Informal Resolution

  • Contact us first to attempt good-faith negotiation for dispute resolution

  • We aim to resolve disputes within 14 business days

10.2 Formal Process

  • If informal resolution fails, disputes will be resolved through arbitration in accordance with the Arbitration Foundation of Southern Africa (AFSA) rules

  • Arbitration takes place in Gauteng, South Africa

  • Governing law is the laws of the Republic of South Africa

10.3 Class Action Waiver

  • Disputes must be resolved individually (no class actions)

  • You waive any right to participate in class-wide proceedings

11. Prohibited Conduct

Users may not:

  • Use the Platform for illegal purposes or in violation of any laws

  • Attempt to access other users’ accounts or data

  • Interfere with or disrupt the Platform’s operation

  • Reverse engineer, decompile, or disassemble Platform software

  • Use automated systems (bots, scrapers) to access the Platform without permission

  • Post false, misleading, defamatory, or offensive content

  • Impersonate any person or entity

  • Solicit providers or customers for off-platform transactions to avoid commission

12. Account Security

12.1 Customer Accounts

  • You are responsible for maintaining confidentiality of your login credentials

  • You must notify us immediately of any unauthorized access

  • You are responsible for all activity under your account

12.2 Provider Accounts

  • Provider portal access is unique to each provider

  • You must not share login credentials with other providers

  • You must maintain accurate contact and banking information

  • Regular security audits may be conducted

13. Marketing and Communications

13.1 Communications You Receive

  • Booking confirmations, updates, and service-related notices (essential)

  • Promotional content (blog posts, social media, offers) with your consent

  • Phase 3 (January 2027+): WhatsApp & SMS alerts (opt-in required)

13.2 Opt-Out

  • You may unsubscribe from promotional communications at any time

  • Service-related communications cannot be opted out (essential for operations)

  • Unsubscribe links included in all promotional emails

The Platform may contain links to third-party websites (Facebook, Google, LinkedIn, payment gateways, banking services). We:

  • Do not control and are not responsible for third-party content or practices

  • Encourage you to review third-party privacy policies and terms

  • Include third-party services solely for convenience

15. Changes to These Terms

  • We may update these Terms at any time by posting revised versions on the Platform

  • Effective date will be updated at the top

  • Continued use of the Platform after changes constitutes acceptance of new Terms

  • Material changes will be communicated via email or prominent website notice

  • Previous versions will be archived for reference

16. Termination

16.1 By You

  • You may stop using the Platform at any time

  • You may request account deletion (subject to legal retention requirements)

16.2 By Us

  • We may suspend or terminate your access at any time, with or without cause

  • We may terminate for violations of these Terms

  • Upon termination, your right to use the Platform ceases immediately

  • Sections on liability, indemnification, intellectual property, and dispute resolution survive termination

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Reaipela Cleaners Marketplace regarding Platform use.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

17.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We are not liable for delays or failures caused by events beyond our control (natural disasters, pandemics, government actions, internet outages).
